This patent license shall 78*46c4c49dSIbrahim Kanouche apply to the combination of the Contribution and the Program if, at 79*46c4c49dSIbrahim Kanouche the time the Contribution is added by the Contributor, such addition 80*46c4c49dSIbrahim Kanouche of the Contribution causes such combination to be covered by the 81*46c4c49dSIbrahim Kanouche Licensed Patents. The patent license shall not apply to any other 82*46c4c49dSIbrahim Kanouche combinations which include the Contribution. No hardware per se is 83*46c4c49dSIbrahim Kanouche licensed hereunder. 84*46c4c49dSIbrahim Kanouche 85*46c4c49dSIbrahim Kanouche c) Recipient understands that although each Contributor grants the 86*46c4c49dSIbrahim Kanouche licenses to its Contributions set forth herein, no assurances are 87*46c4c49dSIbrahim Kanouche provided by any Contributor that the Program does not infringe the 88*46c4c49dSIbrahim Kanouche patent or other intellectual property rights of any other entity. 89*46c4c49dSIbrahim Kanouche Each Contributor disclaims any liability to Recipient for claims 90*46c4c49dSIbrahim Kanouche brought by any other entity based on infringement of intellectual 91*46c4c49dSIbrahim Kanouche property rights or otherwise. As a condition to exercising the 92*46c4c49dSIbrahim Kanouche rights and licenses granted hereunder, each Recipient hereby 93*46c4c49dSIbrahim Kanouche assumes sole responsibility to secure any other intellectual 94*46c4c49dSIbrahim Kanouche property rights needed, if any. For example, if a third party 95*46c4c49dSIbrahim Kanouche patent license is required to allow Recipient to Distribute the 96*46c4c49dSIbrahim Kanouche Program, it is Recipient's responsibility to acquire that license 97*46c4c49dSIbrahim Kanouche before distributing the Program. 98*46c4c49dSIbrahim Kanouche 99*46c4c49dSIbrahim Kanouche d) Each Contributor represents that to its knowledge it has 100*46c4c49dSIbrahim Kanouche sufficient copyright rights in its Contribution, if any, to grant 101*46c4c49dSIbrahim Kanouche the copyright license set forth in this Agreement. 102*46c4c49dSIbrahim Kanouche 103*46c4c49dSIbrahim Kanouche e) Notwithstanding the terms of any Secondary License, no 104*46c4c49dSIbrahim Kanouche Contributor makes additional grants to any Recipient (other than 105*46c4c49dSIbrahim Kanouche those set forth in this Agreement) as a result of such Recipient's 106*46c4c49dSIbrahim Kanouche receipt of the Program under the terms of a Secondary License 107*46c4c49dSIbrahim Kanouche (if permitted under the terms of Section 3). 108*46c4c49dSIbrahim Kanouche 109*46c4c49dSIbrahim Kanouche3. REQUIREMENTS 110*46c4c49dSIbrahim Kanouche 111*46c4c49dSIbrahim Kanouche3.1 If a Contributor Distributes the Program in any form, then: 112*46c4c49dSIbrahim Kanouche 113*46c4c49dSIbrahim Kanouche a) the Program must also be made available as Source Code, in 114*46c4c49dSIbrahim Kanouche accordance with section 3.2, and the Contributor must accompany 115*46c4c49dSIbrahim Kanouche the Program with a statement that the Source Code for the Program 116*46c4c49dSIbrahim Kanouche is available under this Agreement, and informs Recipients how to 117*46c4c49dSIbrahim Kanouche obtain it in a reasonable manner on or through a medium customarily 118*46c4c49dSIbrahim Kanouche used for software exchange; and 119*46c4c49dSIbrahim Kanouche 120*46c4c49dSIbrahim Kanouche b) the Contributor may Distribute the Program under a license 121*46c4c49dSIbrahim Kanouche different than this Agreement, provided that such license: 122*46c4c49dSIbrahim Kanouche i) effectively disclaims on behalf of all other Contributors all 123*46c4c49dSIbrahim Kanouche warranties and conditions, express and implied, including 124*46c4c49dSIbrahim Kanouche warranties or conditions of title and non-infringement, and 125*46c4c49dSIbrahim Kanouche implied warranties or conditions of merchantability and fitness 126*46c4c49dSIbrahim Kanouche for a particular purpose; 127*46c4c49dSIbrahim Kanouche 128*46c4c49dSIbrahim Kanouche ii) effectively excludes on behalf of all other Contributors all 129*46c4c49dSIbrahim Kanouche liability for damages, including direct, indirect, special, 130*46c4c49dSIbrahim Kanouche incidental and consequential damages, such as lost profits; 131*46c4c49dSIbrahim Kanouche 132*46c4c49dSIbrahim Kanouche iii) does not attempt to limit or alter the recipients' rights 133*46c4c49dSIbrahim Kanouche in the Source Code under section 3.2; and 134*46c4c49dSIbrahim Kanouche 135*46c4c49dSIbrahim Kanouche iv) requires any subsequent distribution of the Program by any 136*46c4c49dSIbrahim Kanouche party to be under a license that satisfies the requirements 137*46c4c49dSIbrahim Kanouche of this section 3. 138*46c4c49dSIbrahim Kanouche 139*46c4c49dSIbrahim Kanouche3.2 When the Program is Distributed as Source Code: 140*46c4c49dSIbrahim Kanouche 141*46c4c49dSIbrahim Kanouche a) it must be made available under this Agreement, or if the 142*46c4c49dSIbrahim Kanouche Program (i) is combined with other material in a separate file or 143*46c4c49dSIbrahim Kanouche files made available under a Secondary License, and (ii) the initial 144*46c4c49dSIbrahim Kanouche Contributor attached to the Source Code the notice described in 145*46c4c49dSIbrahim Kanouche Exhibit A of this Agreement, then the Program may be made available 146*46c4c49dSIbrahim Kanouche under the terms of such Secondary Licenses, and 147*46c4c49dSIbrahim Kanouche 148*46c4c49dSIbrahim Kanouche b) a copy of this Agreement must be included with each copy of 149*46c4c49dSIbrahim Kanouche the Program. 150*46c4c49dSIbrahim Kanouche 151*46c4c49dSIbrahim Kanouche3.3 Contributors may not remove or alter any copyright, patent, 152*46c4c49dSIbrahim Kanouchetrademark, attribution notices, disclaimers of warranty, or limitations 153*46c4c49dSIbrahim Kanoucheof liability ("notices") contained within the Program from any copy of 154*46c4c49dSIbrahim Kanouchethe Program which they Distribute, provided that Contributors may add 155*46c4c49dSIbrahim Kanouchetheir own appropriate notices. 156*46c4c49dSIbrahim Kanouche 157*46c4c49dSIbrahim Kanouche4. COMMERCIAL DISTRIBUTION 158*46c4c49dSIbrahim Kanouche 159*46c4c49dSIbrahim KanoucheCommercial distributors of software may accept certain responsibilities 160*46c4c49dSIbrahim Kanouchewith respect to end users, business partners and the like. While this 161*46c4c49dSIbrahim Kanouchelicense is intended to facilitate the commercial use of the Program, 162*46c4c49dSIbrahim Kanouchethe Contributor who includes the Program in a commercial product 163*46c4c49dSIbrahim Kanoucheoffering should do so in a manner which does not create potential 164*46c4c49dSIbrahim Kanoucheliability for other Contributors. Therefore, if a Contributor includes 165*46c4c49dSIbrahim Kanouchethe Program in a commercial product offering, such Contributor 166*46c4c49dSIbrahim Kanouche("Commercial Contributor") hereby agrees to defend and indemnify every 167*46c4c49dSIbrahim Kanoucheother Contributor ("Indemnified Contributor") against any losses, 168*46c4c49dSIbrahim Kanouchedamages and costs (collectively "Losses") arising from claims, lawsuits 169*46c4c49dSIbrahim Kanoucheand other legal actions brought by a third party against the Indemnified 170*46c4c49dSIbrahim KanoucheContributor to the extent caused by the acts or omissions of such 171*46c4c49dSIbrahim KanoucheCommercial Contributor in connection with its distribution of the Program 172*46c4c49dSIbrahim Kanouchein a commercial product offering. The obligations in this section do not 173*46c4c49dSIbrahim Kanoucheapply to any claims or Losses relating to any actual or alleged 174*46c4c49dSIbrahim Kanoucheintellectual property infringement. That Contributor is then a Commercial 183*46c4c49dSIbrahim KanoucheContributor. If that Commercial Contributor then makes performance 184*46c4c49dSIbrahim Kanoucheclaims, or offers warranties related to Product X, those performance 185*46c4c49dSIbrahim Kanoucheclaims and warranties are such Commercial Contributor's responsibility 186*46c4c49dSIbrahim Kanouchealone.
